Pausa — Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Infinitespot Services OÜ (“we”, “us”, “our”) and govern your use of the Pausa iOS app and any related services we provide (“the Service”). By downloading, installing, or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

These Terms are intentionally short and plain — read them.

1. The Service

Pausa is a language-learning app that records short audio sessions, transcribes and analyzes them, and helps you build a vocabulary library. The Service includes the iOS app, server-side processing performed by us or our subprocessors, and any documentation we provide. The Service is provided “as is” and may change, improve, or be discontinued at our discretion (see §10).

2. Who can use the Service

You may use the Service if:

• You are at least 13 years old.
• You can form a legally binding contract under the law of your country of residence, or your legal guardian has accepted these Terms on your behalf.
• You have not been previously banned from the Service for breach of these Terms.

If you’re using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms, and “you” means both you personally and that organisation.

3. Your account

You sign in to the Service with Sign In with Apple. We do not store your Apple ID password — Apple handles that. We do store a pseudonymous account identifier Apple gives us, which lets us scope your library and saved words to your account on the device.

You are responsible for the activity that happens under your account, including any words, audio, or feedback you submit. You agree to:

• Keep your Apple ID secure.
• Sign out (Settings → Sign out) if you no longer want the Service to be active on a shared device.
• Not impersonate anyone else.

You can delete your account from inside the app at any time (Settings → Delete account). Account deletion is permanent: your library, sessions, recordings, and settings on this device are wiped, and we ask our subprocessors to delete server-side copies subject to their retention windows (see §3 of the Privacy Policy).

4. Acceptable use

You agree not to:

• Use the Service for any illegal purpose, or to record audio of others without their consent where consent is legally required.
• Attempt to reverse-engineer, decompile, or otherwise extract the source code of the Service, except to the extent applicable law specifically permits.
• Probe, scan, or test the vulnerability of any part of the Service without our prior written permission.
• Use the Service to harm minors, distribute malware, infringe intellectual-property rights, harass anyone, or generate illegal content.
• Submit feedback, words, or any text content that is unlawful, threatening, defamatory, obscene, hateful, or that violates anyone’s privacy.
• Use the Service in a way that imposes an unreasonable load on our infrastructure or our subprocessors’ infrastructure (e.g. scripted abuse of the transcription or enrichment endpoints).

We reserve the right to suspend or terminate your account if you breach this section.

5. Your content

You retain ownership of any audio, transcripts, saved words, or feedback you submit through the Service (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, transmit, transcribe, analyse, and otherwise process Your Content solely as needed to operate, secure, and improve the Service. We will not sell Your Content or share it for purposes outside those described in our Privacy Policy.

You are responsible for ensuring that you have the right to submit Your Content — for example, that any voice recording is yours, or that people whose voices appear have given their consent.

6. Our content

The Service, including the app code, branding, design, and documentation, is owned by Infinitespot Services OÜ or our licensors and is protected by copyright, trademark, and other intellectual-property laws. These Terms do not transfer any ownership to you. You may use the Service for personal, non-commercial purposes only, except where we explicitly agree otherwise in writing.

The third-party technologies we use (on-device speech-recognition models, the optional Speechmatics cloud transcription service, OpenAI’s language models, Apple’s TranslationKit) remain the property of their respective owners and are subject to their own terms.

7. Subscriptions and payments

The Service is offered on a paid basis through Apple’s In-App Purchase. After completing onboarding, you’ll see a paywall with the subscription option:

• Pausa Monthly — a recurring monthly subscription. The price is shown on the paywall and is localized by Apple for your region. The first 7 days are a free trial offered as Apple’s Introductory Offer. You won’t be charged during the trial; if you do not cancel before the trial ends, the subscription auto-renews and your Apple ID is charged for the first full month.

Auto-renewal and cancellation. The monthly subscription automatically renews at the end of each billing period at the then-current rate unless you cancel at least 24 hours before the period ends. You can cancel at any time from iOS Settings → your Apple ID → Subscriptions, or directly from inside the app at Settings → Manage Subscription. Canceling stops future charges; you keep access until the end of the paid period.

Refunds. Apple — not us — processes all refund requests for in-app purchases. Use reportaproblem.apple.com within the window Apple specifies (typically 90 days). Local consumer-protection law may grant you additional rights, which apply on top of Apple’s policy.

Price changes. We may change the price of the subscription at renewal. If we do, Apple will notify you and ask you to confirm before any increased charge.

Family Sharing. The subscription supports Apple’s Family Sharing where applicable, subject to Apple’s policies.

Restoring purchases. If you reinstall the app, switch devices, or sign into a new iCloud account, tap Restore purchases on the paywall to re-fetch your entitlement from Apple’s servers.

Apple handles all in-app purchases through your Apple ID. Refund policies and billing are also governed by Apple’s Media Services Terms.

8. Beta features

Some features may be marked beta, experimental, or labelled with a similar tag. Beta features are provided as-is, may change without notice, may behave unexpectedly, and may collect additional diagnostic data while we evaluate them. Don’t rely on beta features for anything critical.

9. Service availability

We aim for the Service to be available continuously, but we don’t guarantee it. The Service may be unavailable from time to time because of scheduled maintenance, third-party outages (Apple, OpenAI, Speechmatics, PostHog), bugs, or external factors outside our control. We are not liable for any loss you incur because the Service was unavailable.

10. Changes to the Service or Terms

We may modify the Service (add features, remove features, change how something works) at any time. Material changes to these Terms will be communicated to you:

• By updating the “Last updated” date at the top of this document;
• By surfacing a notice the next time you open the app, where the change materially affects your rights;
• By email (only when you have opted into marketing emails and the change is significant).

If you keep using the Service after a change takes effect, you accept the updated Terms. If you don’t accept them, your remedy is to delete your account.

11. Termination

You can terminate your relationship with us at any time by deleting your account (Settings → Delete account) or simply deleting the app.

We may terminate your access to the Service if you breach these Terms, if we discontinue the Service, or if we are required to by law. Where we terminate for a breach by you, we’ll give you reasonable notice unless doing so is impractical (e.g. urgent security action).

Sections that by their nature should survive termination — Your Content licence (limited to existing copies, §5), our IP (§6), liability and indemnity (§§12–13), and governing law (§14) — survive termination.

12. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don’t warrant that the Service will be uninterrupted, secure, or free from errors, or that any defect will be corrected.

The language-model outputs (transcriptions, translations, definitions, examples) are generated by third-party systems and may contain errors or omissions. Don’t rely on them for high-stakes decisions (medical, legal, financial). Always verify against an authoritative source if accuracy matters.

13. Limitation of liability

To the maximum extent permitted by applicable law:

• In no event will Infinitespot Services OÜ, its directors, employees, agents, or subprocessors be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Service.
• Our total liability to you for all claims arising out of or related to the Service, regardless of the form of action, is limited to the greater of: (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) EUR 50.

This limitation applies regardless of whether the liability is based on contract, tort, negligence, strict liability, statute, or any other legal theory, and even if we have been advised of the possibility of such damages. Some jurisdictions don’t allow these limitations, in which case they apply to the maximum extent permitted by law.

14. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Estonia, without regard to conflict-of-laws principles. The Estonian courts have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Service, subject to your statutory consumer-protection rights under the law of your country of habitual residence.

If you are an EU resident, you can also use the European Commission’s Online Dispute Resolution platform.

15. Miscellaneous

• Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us about the Service.
• No waiver. If we don’t enforce a provision of these Terms, that’s not a waiver of that provision.
• Severability. If any part of these Terms is held unenforceable, the rest stays in effect.
• No assignment. You may not assign these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
• Notices. We may send legal notices to you through the app or to the email address you provided in the Profile editor. Notices to us should go to support@infinitespot.co.
